The District Court of Appeal of Florida denied an appeal filed by Elvis Mahic against the State of Florida. The court treated the appeal of an order denying a motion to disqualify the judge as a petition for writ of prohibition and subsequently denied it. The decision was issued on March 6, 2026.
What changed
The District Court of Appeal of Florida, Second District, denied an appeal filed by Elvis Mahic, pro se, against the State of Florida. The court recharacterized Mahic's appeal of an order denying his motion to disqualify the presiding judge in a postconviction proceeding as a petition for writ of prohibition and denied this petition. The underlying case involves postconviction proceedings.
This ruling signifies the final disposition of Mahic's attempt to disqualify the judge. For legal professionals and courts involved in similar proceedings, this case reinforces the procedural pathway for challenging judicial disqualification orders in Florida, treating such challenges as petitions for writ of prohibition. There are no immediate compliance actions required for regulated entities, as this is a specific case outcome.
