Summary

The Minnesota Supreme Court has ordered attorney Eugene F. Kelly transferred to disability inactive status, effective February 26, 2026. This order stays pending disciplinary investigations against him, contingent on his petition for reinstatement.

What changed

The Minnesota Supreme Court has issued an order transferring attorney Eugene F. Kelly to disability inactive status, effective February 26, 2026. This action follows a petition filed by the Director of the Office of Lawyers Professional Responsibility, supported by evidence confirming Mr. Kelly's inability to assist in his defense or competently practice law due to a disability. The court has also agreed to stay pending disciplinary investigations against him, as stipulated by Mr. Kelly and the Director.

As a result of this order, Mr. Kelly is prohibited from rendering legal advice, discussing legal matters with clients, or otherwise engaging in the practice of law. He must also comply with Rule 26 of the Rules on Lawyers Professional Responsibility, which requires notifying clients, opposing counsel, and tribunals of his transfer. The stay on disciplinary investigations will automatically lift if Mr. Kelly petitions for reinstatement, at which point the allegations of misconduct will be considered, and reinstatement will be conditioned on demonstrating recovery through expert medical evidence and a determination of fitness to practice.

What to do next

  1. Review Rule 26, RLPR requirements for notification of transfer to disability inactive status.
  2. Monitor any petition for reinstatement filed by Eugene F. Kelly.
  3. Ensure no legal advice or services are provided by Eugene F. Kelly.
