Martinez v. Sierra Lifestar: EMS Bonus Not Unique Defense, Reversing Class Certification Denial
The California Fifth Appellate District reversed the Tulare County Superior Court's denial of Adam Martinez's motion for class certification in his wage and hour lawsuit against Sierra Lifestar, Inc. The trial court had found Martinez's claim was not typical because he received only one type of bonus—the EMS Bonus—while Lifestar paid 10 types of bonuses. The appellate court held this was legal error: Lifestar's arguments that the EMS Bonus was properly excluded as a gift or discretionary bonus are not unique to Martinez and apply equally to all employees who received an EMS Bonus for National Emergency Medical Services Week. The case is remanded for reconsideration of class certification.
