The California Court of Appeal, Fifth Appellate District, reversed the Tulare County Superior Court's denial of class certification in Martinez v. Sierra Lifestar, Inc., finding the trial court applied an incorrect legal standard. The court held that Lifestar's defense that Martinez's EMS Bonus was properly excluded from the regular rate of pay because it was discretionary or a gift was not 'unique to Martinez' and therefore did not defeat typicality. The defense applies equally to all EMS Bonuses paid to Lifestar's employees for National Emergency Medical Services Week. The case was remanded for reconsideration of the class certification motion.
