Wescott v. Stanfill - IOLTA Compelled Speech Constitutional Challenge

The First Circuit affirmed the District Court's dismissal of constitutional claims brought by Maine law firm Russell Johnson Beaupain and its client David Wescott challenging Maine's Interest on Lawyers' Trust Accounts (IOLTA) program. The plaintiffs alleged that Maine Bar Rule 6, which requires attorneys to deposit client funds in pooled IOLTA accounts with interest remitted to Maine Justice Foundation for access-to-justice purposes, unconstitutionally compels speech in violation of the First and Fourteenth Amendments under 42 U.S.C. § 1983. The First Circuit upheld the dismissal of claims against State Defendants on the merits and against Maine Justice Foundation for lack of jurisdiction.
