WV Supreme Court Affirms Voter Registration Fraud Conviction

The Supreme Court of Appeals of West Virginia affirmed Darrell R. Sharp II's conviction for illegal application for voter registration under W. Va. Code § 3-2-32(b). Sharp, a felon on parole, submitted a voter registration application at the DMV in March 2023, falsely affirming he was not on parole. The circuit court sentenced him to twelve months in jail and a $1,000 fine. The appellate court found the trial court erred by omitting the statutory "knowing or having reason to know" mens rea from the jury instruction but held the error did not affect Sharp's substantial rights.
