Blackstone v Nextera Motion Dismiss Granted

The Delaware Superior Court granted Nextera Energy Transmission Investments' motion to dismiss Blackstone Power & Natural Resources Holdco's claims for declaratory judgment and breach of contract. The court held that Blackstone's dispute over earn-out payments from the 2020 acquisition of GridLiance falls within the scope of a mandatory expert determination clause in the purchase and sale agreement, and that the parties waived their right to litigate such claims in court.
