United States v. Holley - Sentence Affirmed on Grouping and Consecutive Sentencing Challenges
The Fourth Circuit affirmed Xavier Holley's 480-month sentence for attempted Hobbs Act robbery and conspiracy, rejecting his challenges to the district court's grouping of counts and its authority to impose consecutive sentences. The appellate court held that any grouping error was harmless because the offense level remained at 45 regardless of grouping, and that consecutive sentences for conspiracy and attempted robbery are permissible under 18 U.S.C. § 3584(a) per this circuit's precedent in United States v. Oliver.
DOL Modifies Eight Privacy Act Systems of Records Adding Treasury Disclosure Routine Uses
The Department of Labor is modifying eight Privacy Act systems of records to add new routine uses. The modifications permit disclosure of records to the U.S. Department of the Treasury for review through the Do Not Pay Working System to identify, prevent, or recoup improper payments under Executive Order 14249 and OMB Memorandum M-25-32. DOL is also adding two model breach notification routine uses from OMB Memorandum M-17-12 to all eight systems.
Special Conditions Skyryse Robinson R66 Helicopter Fly-by-Wire Flight Control System Annunciation
The FAA proposes special conditions for the Robinson Model R66 helicopter as modified by Skyryse with a digital fly-by-wire flight control system, replacing mechanical flight controls. The existing airworthiness standards under 14 CFR Part 27 do not adequately address this novel design feature, requiring additional safety standards including an annunciation requirement for pilot awareness. Comments are due by June 5, 2026.
