Summary

The UK Secretary of State has revoked the Merchant Shipping (Monitoring, Reporting and Verification of Carbon Dioxide Emissions) Regulations 2026. This action removes retained EU law related to CO2 emissions from maritime transport, effective April 3, 2026.

What changed

The UK Secretary of State, exercising powers under the Retained EU Law (Revocation and Reform) Act 2023, has revoked the Merchant Shipping (Monitoring, Reporting and Verification of Carbon Dioxide Emissions) Regulations 2026. This revocation specifically targets retained EU legislation, including Regulation (EU) 2015/757 and related UK statutory instruments, which previously governed the monitoring, reporting, and verification of CO2 emissions from maritime transport. The stated rationale is to remove this secondary retained EU law without replacement, as no significant impact on the private, voluntary, or public sectors is foreseen.

This regulatory change effectively removes the existing framework for CO2 emissions MRV for maritime transport in the UK. While no direct replacement is provided, and no immediate compliance actions are mandated by this revocation itself, regulated entities, primarily transportation companies, should be aware that the previous obligations under the revoked regulations are no longer in force. Companies should verify their current reporting and monitoring procedures and consult with legal counsel to understand any potential residual implications or future policy developments in this area. The revocation comes into force on April 3, 2026.

What to do next

  1. Review current CO2 emissions monitoring and reporting procedures for maritime transport.
  2. Confirm cessation of obligations under revoked EU and UK regulations.
  3. Consult legal counsel regarding any residual implications or future regulatory changes.
