Summary

The Department of Justice in Northern Ireland has issued the Court of Judicature (Non-Contentious Probate) Fees (Amendment) Order (Northern Ireland) 2026. This order amends the 1996 Fees Order, increasing probate fees effective April 1, 2026, with further increases scheduled for 2027 and 2028.

What changed

The Department of Justice in Northern Ireland has issued the Court of Judicature (Non-Contentious Probate) Fees (Amendment) Order (Northern Ireland) 2026, which amends the existing 1996 Fees Order. The primary change involves substituting Schedule 1 with new fee structures that increase probate application fees. These increases are phased, with specific fee adjustments set to take effect on April 1, 2026, April 1, 2027, and April 1, 2028, impacting various types of probate applications, including general applications, personal applications, and special applications related to estates exempt from inheritance tax or limited to trust property.

Legal professionals and individuals involved in probate applications in Northern Ireland must be aware of these upcoming fee increases. The new fee schedule will directly impact the cost of obtaining grants of probate or resealing grants. Compliance requires adherence to the updated fee structure starting April 1, 2026. While no specific compliance deadline is mentioned beyond the effective date, affected parties should ensure their financial planning and client advice account for these increased costs to avoid delays or complications in the probate process.

What to do next

  1. Update internal fee schedules to reflect the new probate fees effective April 1, 2026.
  2. Advise clients on the increased probate application costs for 2026, 2027, and 2028.
  3. Ensure accurate fee collection for all probate applications processed from April 1, 2026.
