The Welsh Ministers make the following Regulations in exercise of the powers conferred by sections 45 and 48(1)(b) of the Food Safety Act 1990(1) and now vested in them(2).
In accordance with section 48(4A)(3) of that Act, the Welsh Ministers have had regard to advice given by the Food Standards Agency on the proposal to make these Regulations.
There has been consultation as required by Article 9 of Regulation (EC) No 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down the procedures in matters of food safety(4).
Title, application and coming into force
- —(1) The title of these Regulations is the Charges for Residues Surveillance (Amendment) (Wales) Regulations 2026.
(2) These Regulations apply in relation to Wales.
(3) These Regulations come into force on 1 April 2026.
Amendment to the Charges for Residues Surveillance Regulations 2006
- —(1) The Charges for Residues Surveillance Regulations 2006(5) are amended as follows.
(2) In regulation 3 (liability for and recovery of charges for residues surveillance)—
(a) in paragraph (1)(a)—
(i) for “1 October 2024” substitute “1 April 2026”;
(ii) for “31 March 2025” substitute “31 March 2027”;
(b) in paragraph (1)(b), for “1 April 2025” substitute “1 April 2027”.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Charges for Residues Surveillance Regulations 2006 (S.I. 2006/2285) in relation to Wales.
These Regulations vary the fees required to be paid in respect of the surveillance of animals and animal products for residues of veterinary medicinal products and other substances.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.
(1) 1990 c. 16. Section 45(1) and (2) of the Food Safety Act 1990 (“ the 1990 Act ”) was amended by paragraphs 7, 8 and 20 of Schedule 5 to the Food Standards Act 1999 (c. 28) (“ the 1999 Act ”). Section 48(1) was amended by paragraphs 7, 8 and 21 of Schedule 5 to the 1999 Act.
(2) The functions, formerly exercised by “the Ministers”, so far as exercisable in relation to Wales, were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) as read with section 40(3) of the 1999 Act. Those functions are now exercisable by the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32).
(3) Section 48(4A) was inserted by paragraph 21 of Schedule 5 to the 1999 Act.

(5) S.I. 2006/2285; relevant amending instruments are S.I. 2007/2439, 2008/2999, 2009/2779, 2011/2945, 2024/967 (W. 162) and 2025/370 (W. 73).
