Summary

The "Deporting Fraudsters Act of 2026" (H.R. 1958) amends the Immigration and Nationality Act to make aliens convicted of defrauding the U.S. government or unlawfully receiving public benefits inadmissible and deportable. This bill was reported by the House Committee on the Judiciary and ordered to be printed.

What changed

H.R. 1958, the "Deporting Fraudsters Act of 2026," proposes to amend the Immigration and Nationality Act to explicitly define certain fraud and unlawful receipt of public benefits offenses as grounds for inadmissibility and deportability. Specifically, it adds a new subsection (J) to Section 212(a)(2) of the Act, targeting convictions or admissions related to defrauding the U.S. government or the unlawful receipt of benefits such as SNAP, Social Security fraud, theft or bribery concerning federal programs, identification document fraud, major fraud against the U.S., and mail fraud.

This legislation will have significant implications for immigration enforcement and adjudication. Aliens convicted of or admitting to these offenses will be subject to inadmissibility and deportability. Compliance officers and legal professionals involved in immigration cases should familiarize themselves with the specific offenses listed in the bill, as these will now serve as clear triggers for immigration consequences. The bill was reported by the House Committee on the Judiciary on January 27, 2026, indicating it is moving through the legislative process.

What to do next

  1. Review the specific offenses listed in H.R. 1958 that trigger inadmissibility and deportability.
  2. Update internal training and case assessment protocols to incorporate these new grounds for inadmissibility and deportability.
  3. Monitor the legislative progress of H.R. 1958 through Congress.
