Summary

The Department of Labor (DOL) is seeking OMB approval for a new information collection request (ICR) related to workers' compensation inquiries for black lung disability claims. Public comments are invited on the necessity, utility, and burden of this collection.

What changed

The Department of Labor (DOL), through its Office of Workers' Compensation Programs (OWCP), has submitted an Information Collection Request (ICR) to the Office of Management and Budget (OMB) for review and approval under the Paperwork Reduction Act (PRA). This ICR, associated with OWCP Form CM-905, pertains to the collection of information regarding state or federal workers' compensation benefits received by individuals claiming black lung disability. The DOL is seeking authorization for this collection for three years, with an estimated annual burden of 995 hours and $2,973 in other costs for approximately 3,980 respondents.

Regulated entities, specifically state, local, and tribal governments, are invited to submit comments on the necessity, accuracy, utility, and clarity of this information collection. The comment period is open until April 10, 2026. While no direct penalties are stated for non-compliance with this specific notice, the PRA generally prohibits the enforcement of information collection requirements that have not received OMB approval and do not display a valid OMB Control Number. Compliance officers should review the proposed collection and submit comments if they identify any issues.

What to do next

  1. Review the DOL's Information Collection Request (ICR) for OWCP Form CM-905.
  2. Submit comments to www.reginfo.gov/public/do/PRAMain by April 10, 2026, if any concerns regarding the collection's necessity, utility, or burden are identified.

Penalties

No direct penalties are stated for non-compliance with this notice; however, the PRA generally prohibits the enforcement of information collection requirements that have not received OMB approval and do not display a valid OMB Control Number.

SUPPLEMENTARY INFORMATION:

The OWCP Division of Coal Mine Workers' Compensation must collect information regarding the status of any worker's compensation
inquiry for Federal or State claims regarding benefits received attributable to black lung disability. The OWCP Form CM-905
requests the amount of those workers' compensation benefits and is submitted from Federal or state agencies when the beneficiary
has filed a claim for workers' compensation benefits due to pneumoconiosis or is receiving benefits that may need to be offset.
For additional substantive information about this ICR, see the related notice published in the
Federal Register
on December 31, 2025 (90 FR 61420).

This information collection is subject to the PRA. A Federal agency generally cannot conduct or sponsor a collection of information,

a currently valid OMB Control Number. In addition, notwithstanding any other provisions of law, no person shall generally
be subject to penalty for failing to comply with a collection of information that does not display a valid OMB Control Number.
See 5 CFR 1320.5(a) and 1320.6.

DOL seeks PRA authorization for this information collection for three (3) years. OMB authorization for an ICR cannot be for
