SURGICAL TECHNOLOGIST CERTIFICATION

Title protection was granted to Surgical Technologists by the 2022 General Assembly. The Code of Virginia § 54.1-2956.12. Registered surgical technologist; use of title; registration reads:

  1. No person shall hold himself out to be a surgical technologist or use or assume the title of "surgical technologist" or "certified surgical technologist," or use the designation "S.T." or any variation thereof, unless such person is certified by the

Board. In 2023, the General Assembly extended the period for grandfathering individuals into

certification by the Board until December 31, 2023. Unfortunately, quite a few surgical

technologists, including graduates of surgical technology programs, have not been aware of

the requirement for certification by the Board and end up becoming certified through a

disciplinary Pre-Hearing Consent Order that acknowledges the period of unlicensed practice.

The Board of Medicine has no way of notifying individuals of the requirement for certification

except by this newsletter. And this newsletter only goes to those already regulated by the

Board. Information about the requirement for certification by the Board needs to come from

teachers in surgical technologist programs, supervisors, and employers. If you are in a

position to inform students and colleagues of this requirement, please do.

SIGNING DEATH CERTIFICATES

Apparently, there continues to be some misunderstanding about a practitioner's

responsibility to sign a death certificate. Completing the death certificate is not only the last

act for the patient, but it also helps provide emotional closure for the family and necessary

documentation to take care of the deceased's affairs.

Here is the law in the Board of Medicine's Code Section on Unprofessional Conduct:

"Failing or refusing to complete and file electronically using the Electronic Death Registration System any medical certification in accordance with the requirements

of subsection C of § 32.1-263. However, failure to complete and file a medical

certification electronically using the Electronic Death Registration System in

accordance with the requirements of subsection C of § 32.1-263 shall not constitute

unprofessional conduct if such failure was the result of a temporary technological or electrical failure or other temporary extenuating circumstance that prevented the

electronic completion and filing of the medical certification using the Electronic

Death Registration System." Code of Virginia Section 32.1-263 is the Virginia Department of Health law governing the

completion of death certificates. Subsection C outlines the responsibilities of physicians

and autonomous advanced practice RN's. "…The medical certification shall be completed and filed electronically with the State Registrar of Vital Records using the Electronic Death Registration System within 24 hours after death by the physician or autonomous nurse practitioner in charge of the patient's care for the illness or condition that resulted in death except

when inquiry or investigation by the Office of the Chief Medical Examiner is required

by § 32.1-283 or 32.1-285.1, or by the physician or autonomous nurse practitioner who pronounces death pursuant to § 54.1-2972. If the death occurred while under

the care of a hospice provider, the medical certification shall be completed by the decedent's health care provider and filed electronically with the State Registrar of

Vital Records using the Electronic Death Registration System for completion of the

death certificate.

In the absence of such physician or autonomous nurse practitioner or with his

approval, the certificate may be completed and filed by the following: (i) another

physician or autonomous nurse practitioner employed or engaged by the same professional practice; (ii) a physician assistant supervised by such physician; (iii) an advanced practice registered nurse who is not an autonomous nurse practitioner practicing in accordance with the provisions of § 54.1-2957; (iv) the chief medical

officer or medical director, or his designee, of the institution, hospice, or nursing

home in which death occurred; (v) a physician or autonomous nurse practitioner specializing in the delivery of health care to hospitalized or emergency department patients who is employed by or engaged by the facility where the death occurred; (vi) the physician who performed an autopsy upon the decedent; (vii) an individual to whom the physician or autonomous nurse practitioner has delegated authority to

complete and file the certificate, if such individual has access to the medical history

of the case and death is due to natural causes; or (viii) a physician who is not licensed by the Board of Medicine who was in charge of the patient's care for the illness or condition that resulted in death. A physician described in clause (viii) who

completes a certificate in accordance with this subsection shall not be required to register with the Electronic Death Registration System or complete the certificate

electronically. As used in this subsection, "autonomous nurse practitioner" has the same meaning as provided in § 54.1-2972." Section 32.1-263(D) of the Code of Virginia states: "…If the Office of the Chief Medical Examiner refuses jurisdiction, the physician last

furnishing medical care to the deceased shall prepare and file the medical certification portion of the death certificate." Section 32.1-263(E) states that the

physician or autonomous advanced practice registered nurse shall "use his best

medical judgment to certify a reasonable cause of death or contact the health district

physician director in the district where the death occurred to obtain guidance in reaching a determination as to a cause of death and document the same." If you are not registered with the Electronic Death Registration System (EDRS), you should go ahead and do so.

COOPERATION WITH THE BOARD

The Enforcement Division of the Department of Health Professions (DHP) does the investigative work for all of the Department's 13 health regulatory boards. If you are contacted by someone who is representing himself/herself as an investigator with the Department of Health Professions, know that a DHP investigator will never contact you initially by phone. It will be by email or UPS mail. If you have doubts about the legitimacy of an investigator's identity, you may call the DHP Enforcement Division or the Board of

Medicine for verification.

An investigator may be looking into a complaint lodged against you or another licensee of the Board of Medicine. If the investigator is seeking an interview, records, or other information, it is your responsibility to cooperate. The Board has a regulation that states such: 18VAC85-20-105. Refusal to provide information

A practitioner shall not willfully refuse to provide information or records as requested or required by the board or its representative pursuant to an investigation or to the

enforcement of a statute or regulation.

BE WARY OF SCAMMERS!

Recently, a licensee of the Board of Medicine contacted the Board to ask about being under investigation. The licensee had been contacted by an individual who gave his name and claimed to be the "Chief Investigator" for the Board. He provided a Board of Medicine number to call. The contact was a scam. No such individual exists. As stated above, an investigator from the Department of Health Professions will not initially contact a licensee by phone. It will be either by email or UPS mail. If in doubt, always contact the agency that the individual claims to represent--be it the Board of Medicine, local law enforcement, the DEA, the FBI, or any other entity.

SERVICEMEMBERS' CIVIL RELIEF ACT (SCRA) LICENSING

In 2023, the SCRA was amended to require states to recognize professional licenses issued

by another state for the purpose of facilitating license portability for servicemembers and their spouses who are relocating to another state pursuant to military orders.

In December 2024, the SCRA was amended again. The licensing process now requires:

  1. Completed application
  2. Fee
  3. Military orders to a duty station in Virginia
  4. One primary source state license verification in good standing
  5. Attest that:
  • All licenses are in good standing in all jurisdictions
  • No license has been disciplined
  • No license is currently under investigation
  • No license has ever been voluntarily surrendered while under investigation
  1. Report from the National Practitioner Data Bank
  2. Copy of the marriage certificate for a military spouse applicant
  3. Application must be notarized The Board of Medicine has a link to the SCRA application on its website for all its licensed professions. Although the application is fillable online, it must be printed off and mailed to the Board with the appropriate fee.

REMINDER ABOUT THE 2025 OPIOID REGULATIONS

In March 2023, the Board undertook the revision of the March 2017 regulations governing prescribing of opioids and buprenorphine. The amended regulations became effective in January 2025.

3rd TEMPORARY EXTENSION OF COVID-19 TELEMEDICINE FLEXIBILITIES FOR THE PRESCRIPTION OF CONTROLLED SUBSTANCES

This item is reprinted from the April 2025 Board Briefs. It states that the COVID-19

telemedicine flexibilities will continue until December 31, 2025. The Board is unaware of any further extension of the flexibilities. You may wish to monitor the DEA website for further

information. THIRD TEMPORARY EXTENSION OF COVID-19 TELEMEDICINE FLEXIBILITIES FOR PRESCRIPTION OF CONTROLLED SUBSTANCES

The initial telemedicine flexibilities were issued by DEA in March 2020. Since that

time, there have been extensions for the prescribing of controlled substances by telemedicine.

In 2023, in response to a set of proposed telemedicine rules, DEA received more than 38,000 comments and held two days of public listening sessions. In light of that feedback and discussion, and to give DEA time to consider a new path forward for telemedicine, DEA and the Department of Health and Human Services (HHS)

extended current telemedicine flexibilities through the end of 2024.

We (DEA) continue to carefully consider the input received and are working to

promulgate a final set of telemedicine regulations. However, with the end of 2024 quickly approaching, DEA, jointly with HHS, has extended current telemedicine flexibilities through December 31, 2025. 󷵻󷵼󷵽󷵾 Read the full extension in the Federal Register

PERINATAL AND OTHER DEPRESSION IN WOMEN

The General Assembly requires the Board of Medicine to annually remind its licensees who

provide services to women of the potential for depression in their patients. The reminder: "Shall encourage practitioners to screen every patient who is pregnant or who has

been pregnant within the previous five years for prenatal or postnatal depression or

other depression, as clinically appropriate…" This issue aligns with Governor Youngkin's Maternal Health Data Task Force, which held its

first meeting in October 2024. The Task Force is committed to ensuring that every pregnant

    Two-Question Screen The following two questions are recommended as a quick screen for a past history of

depression which is a significant risk factor. If the answers are "yes" for a pregnant or

postpartum woman, consider referral for counseling or further evaluation. In all cases, interventions should be tailored to the risk presented by the patient and her circumstances.

  1. Was there ever a period of time when you were feeling depressed or down or when
    you lost interest in pleasurable activities most of the day, nearly every day, for at least 2 weeks?

  2. Has a health care professional ever told you that you were depressed? Have you ever
    taken a medication for depression? In a 2023 webinar, Anita H. Clayton, MD and Jennifer L. Payne, MD of UVA Psychiatry provided the following points:

  • Include questions about depression in your interview with patients.
  • Screening tests can be helpful in identifying treatable depression.
  • Post-Partum Depression (PPD) has both genetic and environmental determinants.
  • Previous bouts of depression are predictive for PPD.
  • Family history of depression may be predictive for PPD.
  • Treating depression during pregnancy benefits the mother and the infant.
  • The Edinburgh Postnatal Depression Scale is useful for diagnosis and monitoring
    progress.

  • Antidepressants pose a low risk for breastfeeding infants.

  • Drugs that achieve rapid improvement in PPD are available.

The Virginia Board of Medicine has always wanted its licensees who are struggling with burnout or other issues to get help when they need it. The Board is aware that the stresses of medical school, residency, and practice can weigh heavily on a healthcare provider at times. It's a no-brainer that a healthy provider is better able to care for his or her patients than one who is struggling. Licensees taking care of themselves and seeking help when they need it is good for everybody. Left unattended, mental health issues could affect your patient care. And you don't want that, and your patients don't want that.

REMINDER ABOUT NEW LAWS FOR 2025

Below are summaries of new laws relevant to Board of Medicine licensees that became

effective in 2025:

  • SB882 - Licensure of Anesthesiologist Assistants
    Establishes licensure criteria and directs the Board to adopt regulations. No one may use the title "anesthesiologist assistant" without a license.

  • SB826 - Predetermination for Licensing Eligibility; Prior Convictions
    Prohibits vague or arbitrary terms in license denials. Requires written notice of specific offenses and how they relate to the profession.

  • SB1352 - Independent Practice for Certified Nurse Midwives
    Permits independent practice after 1,000 hours under a practice agreement. Allows midwives to enter agreements with other independently practicing midwives.

FDA LETTER TO THE FSMB ON CAGRILINTIDE

June 2, 2025 Humayun J. Chaudhry, DO, MACP President and CEO Federation of State Medical Boards 400 Fuller Wiser Road, Suite 300 Euless, TX 76309 Dear Dr. Chaudhry: The purpose of this letter is to bring to the attention of the Federation of State Medical Boards information related to compounded drug products containing cagrilintide, some of which claim to treat obesity and other conditions. FDA believes that health care professionals should be advised about the current regulatory status of compounded cagrilintide. Sections 503A and 503B of the Federal Food, Drug, and Cosmetic Act (FD&C Act) describe the conditions that must be satisfied for compounded human drug products to be exempt from certain sections of the FD&C Act, including the requirements of premarket approval and labeling with adequate directions for use. Among the conditions of sections 503A and 503B are restrictions on the bulk drug substances (active pharmaceutical ingredients or APIs) that may be used to compound human drug products. One of the conditions that must be met for a compounded drug product to qualify for the exemptions under section 503A of the FD&C Act is that a licensed pharmacist in a State licensed pharmacy or a Federal facility, or a licensed physician, compounds the drug product using bulk drug substances that: (1) comply with the standards of an applicable United States Pharmacopeia (USP) or National Formulary (NF) monograph, if a monograph exists, and the USP chapter on pharmacy compounding; (2) if such a monograph does not exist, are drug substances that are components of drugs approved by the Secretary; or (3) if such a monograph does not exist and the bulk drug substance is not a component of a drug approved by FDA, appear on a list developed by FDA through regulation ("503A Bulks List") (section 503A(b)(1)(A)(i) of the FD&C Act). Cagrilintide is not the subject of an applicable USP or NF monograph, is not a component of an FDA-approved drug product, and does not appear on the 503A Bulks List. Therefore, compounded cagrilintide products would not at this time qualify for the exemptions under section 503A of the FD&C Act. One of the conditions that must be met for a drug product compounded by an outsourcing facility to qualify for the exemptions under section 503B of the FD&C Act, is that the outsourcing facility does not compound drug products using a bulk drug substance unless: (1) the bulk drug substance appears on a list established by the Secretary identifying bulk drug substances for

which there is a clinical need ("503B Bulks List"), or (2) the drug product compounded from such bulk drug substance appears on FDA's drug shortage list in effect under section 506E at the time of compounding, distribution and dispensing (section 503B(a)(2)(A)(i) and (ii) of the FD&C Act). Cagrilintide does not appear on the 503B Bulks List, nor does it appear on FDA's drug shortage list. Therefore, compounded cagrilintide products would not at this time qualify for the exemptions under section 503B of the FD&C Act. Additionally, FDA has warned companies that have illegally sold unapproved drugs that are falsely labeled "for research purposes" or "not for human consumption." The agency 1 recommends that consumers not purchase products, such as cagrilintide, that do not meet the exemptions of sections 503A or 503B of the FD&C Act, are of unknown quality, and may be harmful to their health. FDA also encourages health care providers to discuss this issue with their patients. We are also sending this letter to the National Association of Boards of Pharmacy and National Council of State Boards of Nursing to facilitate communication among associations with shared goals regarding these matters. We look forward to continuing to work with you on matters related to drug compounding.   • The Psychologist Prescribing Workgroup met in accordance with SB752 on July 9, 2025 and August 15, 2025. It was jointly hosted by the Board of Psychology and the Board of Medicine. Stakeholders from the Boards, professional organizations, and

academia met to discuss the education, training, and qualifications of clinical

psychologists necessary to ensure competent and safe prescribing if clinical psychologists were to be granted prescriptive authority. A report is due to the General Assembly by November 1, 2025.

  • In collaboration with the Board of Nursing, the Board of Medicine met August 20, 2025
    with mental health experts to discuss best practices for prescribing, monitoring, and communication essential to the management of children and adolescents treated with psychotropic medication.

  • On August 25, 2025, the Board of Medicine convened a meeting of the Advisory
    Board on Midwifery along with OB-GYNs from academia to consider revision of the midwifery formulary for consistency with the North American Registry of Midwives 2024 Job Analysis. Appropriate additions were made to the formulary.
