What changed

The Family Procedure Rule Committee published a consultation seeking views on amendments to Family Procedure Rules and Practice Directions to strengthen provisions around Mediation Information and Assessment Meetings (MIAMs) and encourage greater use of non-court dispute resolution (NCDR) in private family law matters. The consultation ran from 30 March to 25 May 2023.

Legal professionals practising in family law, family courts, and mediation service providers should monitor for the outcome publication. If amendments proceed, they may affect practice requirements for MIAM attendance and the handling of private family law disputes outside of court.

What to do next

  1. Monitor for outcome publication on GOV.UK
  2. Review consultation documents for proposed changes to MIAM requirements

Consultation description

This consultation seeks views on the principle of proposed amendments to the existing Family Procedure Rules and supporting Practice Directions. The proposals are intended to strengthen the existing provisions around attendance at Mediation Information and Assessment Meetings (“MIAMs”) and to encourage more people to attend mediation or other forms of non-court dispute resolution (“NCDR”). The consultation will run from 30 March 2023 until 25 May 2023.

The paper follows the government consultation on supporting earlier resolution of private family law arrangements, published earlier this month and can be found here https://consult.justice.gov.uk/.
