The Legal Aid and Advice and Assistance (Fees) (Miscellaneous Amendment) (Scotland) Regulations 2026

Coming into force in accordance with regulation 1

The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 9(1) and (2)(e), 33(2), (3)(a), (b), (c) and (f) and (3A) and 36(1) and (2)(b) of the Legal Aid (Scotland) Act 1986(1) and all other powers enabling them to do so.

In accordance with section 37(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament(2).

Citation and commencement

  1. —(1) These Regulations may be cited as the Legal Aid and Advice and Assistance (Fees) (Miscellaneous Amendment) (Scotland) Regulations 2026.

(2) Subject to paragraphs (3) and (4), these Regulations come into force on 1 June 2026.

(3) Regulations 3 to 8 and schedules 1 to 14 come into force on 1 September 2026.

(4) Regulation 11 and schedule 15 comes into force on 14 December 2026.

Application

  1. —(1) These Regulations apply only in relation to fees for work done or outlays incurred on or after 1 September 2026, except in relation to regulations 6, 7(2), (3)(c) and (e) and 8 to 11.

(2) Regulations 6, 7(2), (3)(c) and (e) and 8 apply only in relation to a case where the grant of legal aid, advice and assistance or assistance by way of representation was made on or after 1 September 2026.

(3) Regulations 9 and 10 apply only in relation to a case where the grant of legal aid, advice and assistance or assistance by way of representation was made on or after 1 June 2026.

(4) Regulation 11 applies only in relation to a case where the grant of legal aid, advice and assistance or assistance by way of representation was made on or after 14 December 2026.

(5) For the purposes of paragraph (1), where work for a fee or fixed payment prescribed in schedules 1 to 15 is conducted over more than one date, the work is deemed to have been done on the day on which the work comes to an end.

Amendment of the Civil Legal Aid (Scotland) (Fees) Regulations 1989

  1. —(1) The Civil Legal Aid (Scotland) (Fees) Regulations 1989(3) are amended as follows.

(2) In regulation 5 (fees allowable to solicitors) in paragraph (2A), for “£26.30”(4) substitute “£29.72”.

(3) In Part 1 of Chapter 3 of the table of fees in schedule 2 (undefended actions), for the first table of fees substitute the table in schedule 1 of these Regulations.

(4) In Part 2 of Chapter 3 of the table of fees in schedule 2 (defended actions), for the first table of fees substitute the table in schedule 2 of these Regulations.

(8) In schedule 5 (table of detailed fees chargeable by solicitors for proceedings in the Court of Session, Sheriff Appeal Court, and Upper Tribunal for Scotland, proceedings listed at regulation 5(3) and proceedings in the sheriff court listed in schedule 7)(7), for the table of fees substitute the table in schedule 6 of these Regulations.

(9) In schedule 6 (table of fees chargeable by solicitors for proceedings in the sheriff court (except summary cause and executry proceedings and the proceedings listed in schedule 7) and in the Sheriff Appeal Court)—

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the following instruments made under the Legal Aid (Scotland) Act 1986 (“ the 1986 Act ”)—

  • the Civil Legal Aid (Scotland) (Fees) Regulations 1989,
  • the Criminal Legal Aid (Scotland) (Fees) Regulations 1989,
  • the Legal Aid in Contempt of Court Proceedings (Scotland) (Fees) Regulations 1992,
  • the Advice and Assistance (Financial Limit) (Scotland) Regulations 1993 (“ the 1993 Regulations ”),
  • the Advice and Assistance (Scotland) Regulations 1996,
  • the Criminal Legal Aid (Fixed Payments) (Scotland) Regulations 1999,
  • the Civil Legal Aid (Scotland) Regulations 2002,
  • the Legal Aid and Advice and Assistance (Miscellaneous Amendment) (Scotland) Regulations 2026,
  • the Criminal Legal Aid and Assistance by Way of Representation (Miscellaneous Amendment) (Scotland) Regulations 2026.
    Regulation 2 provides that—

  • regulations 9 and 10 apply from 1 June 2026,

  • regulations 6 (financial limits), 7(2), (3)(c) and (e) and 8 and 11 apply where the grant of legal aid, advice and assistance or assistance by way of representation was made on or after 1 September 2026 or 14 December 2026 as the case may be,

  • the other amendments in these Regulations apply only in relation to fees for work done or outlays incurred on or after 1 September 2026,

  • where work which qualifies for a fee prescribed under these Regulations is conducted over more than one date, the work is deemed to have been done on the day on which the work comes to an end.
    Regulations 3, 4, 5, 7 and 8 make amendments to the above instruments to increase fees and outlays for legal aid and advice and assistance by 13%.

Regulation 6 amends the 1993 Regulations to substitute the financial limit amounts for advice and assistance specified in section 10(2) of the 1986 Act beyond which solicitors are required to seek prior approval of the Scottish Legal Aid Board before providing further advice and assistance.

Regulations 9 and 10 make corrections and minor drafting and clarificatory changes to the Civil Legal Aid (Scotland) Regulations 2002 and the Legal Aid and Advice and Assistance (Miscellaneous Amendment) (Scotland) Regulations 2026 respectively.

Regulation 11 amends the Criminal Legal Aid and Assistance by Way of Representation (Miscellaneous Amendment) (Scotland) Regulations 2026 so that the amendments made by those Regulations to fixed payments include a 13% increase.

(1) 1986 c. 47. Section 33(2) was amended by section 67(7)(b) of the Legal Profession and Legal Aid (Scotland) Act 2007 (asp 5). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). Section 33(3A) was inserted by section 51 of the Crime and Punishment (Scotland) Act 1997 (c. 48). Section 36(2)(b) was amended by paragraph 6 of schedule 4 of the Legal Aid Act 1988 (c. 34) and section 23(9) of the Scottish Civil Justice Council and Criminal Legal Assistance Act 2013 (asp 3).
