FERC Revocation of Market-Based Rate Authority and Tariff Termination
Summary
The Federal Energy Regulatory Commission (FERC) has revoked the market-based rate authority and terminated the electric market-based rate tariffs of several public utilities. These actions were taken because the utilities failed to file their required Electric Quarterly Reports by the deadline set in a prior order.
What changed
The Federal Energy Regulatory Commission (FERC) has issued a notice revoking the market-based rate authority and terminating the electric market-based rate tariffs for specific public utilities. This action follows the utilities' failure to submit delinquent Electric Quarterly Reports (EQRs) within 15 days of the Commission's March 2, 2026 order. The revocation is effective as of the date of this notice, March 20, 2026.
Public utilities affected by this notice must cease selling power at market-based rates and will no longer operate under their previously approved market-based rate tariffs. Failure to comply with EQR filing requirements has direct and immediate consequences for their ability to conduct energy sales. Affected entities should immediately cease market-based rate sales and ensure all tariff obligations are met, or seek alternative rate authority if applicable.
What to do next
- Cease market-based rate sales
- Confirm tariff termination
- Review EQR filing requirements for future compliance
Penalties
Revocation of market-based rate authority and termination of electric market-based rate tariffs.
