Summary

The U.S. Department of Commerce is rescinding administrative reviews of multiple antidumping and countervailing duty orders covering products from Germany, Taiwan, Netherlands, China, Canada, and Italy. The rescissions follow the timely withdrawal of all review requests within the 90-day deadline under 19 CFR 351.213(d)(1), covering periods of review ranging from 2023 to 2025 for products including steel, mattresses, garlic, tires, and pasta.

What changed

Commerce rescinded administrative reviews for 7 antidumping duty proceedings and 8 countervailing duty proceedings following withdrawal of all review requests within the statutory 90-day period. The affected proceedings cover products including cold-drawn mechanical tubing, mattresses, hot-rolled steel, diamond sawblades, fresh garlic, multilayered wood flooring, stilbenic optical brightening agents, wind towers, forged steel fluid end blocks, pasta, tires, pea protein, and lightweight thermal paper from multiple countries.

Importers of these products will not face new duty assessments from these particular review proceedings, though Commerce will instruct CBP to continue liquidating entries at the applicable cash deposit rates. Foreign exporters and U.S. importers should monitor for updated assessment instructions and ensure cash deposit rates remain current for future entries.

What to do next

  1. Monitor affected AD/CVD orders for changes in assessment rates
  2. Update import compliance procedures for rescinded review periods
  3. Review cash deposit requirements for listed products and countries

Notification to Importers

This notice serves as the only reminder to importers of merchandise subject to AD orders of their responsibility under 19 CFR 351.402(f)(2) to file a certificate regarding the reimbursement of antidumping duties and/or countervailing duties prior to liquidation of the relevant entries during the POR. Failure to comply with this requirement could result in the presumption that reimbursement of antidumping duties and/or countervailing duties occurred and the subsequent assessment of doubled antidumping duties.

Notification Regarding Administrative Protective Order (APO)

This notice also serves as the only reminder to parties subject to an APO of their responsibility concerning the disposition of proprietary information disclosed under APO in accordance with 19 CFR 351.305(a)(3), which continues to govern business proprietary information in these segments of these proceedings. Timely written notification of the return or destruction of APO materials or conversion to judicial protective order is hereby requested. Failure to comply with the regulations and the terms of an APO is a sanctionable violation.

Notification to Interested Parties

This notice is issued and published in accordance with sections 751(a)(1) and 777(i)(1) of the Tariff Act of 1930, as amended, and 19 CFR 351.213(d)(4).
