Planning (Consequential Provisions) (Wales) Bill Passed
Summary
The Welsh Parliament (Senedd) has passed the Planning (Consequential Provisions) (Wales) Bill. This bill amends and repeals enactments and makes transitional provisions in connection with the Planning (Wales) Bill. The bill now moves to a four-week period before Royal Assent.
What changed
The Senedd has passed the Planning (Consequential Provisions) (Wales) Bill, which serves to amend and repeal existing legislation and establish transitional provisions related to the Planning (Wales) Bill. This consolidation bill was introduced by the Welsh Government and has completed its final stage, with a four-week period now preceding Royal Assent. During this period, potential challenges regarding legislative competence can be referred to the Supreme Court, or the Secretary of State for Wales can prohibit the bill from proceeding.
While this bill itself does not impose direct compliance obligations on regulated entities in the immediate sense, it is a critical legislative step that will alter the planning framework in Wales. Compliance officers should note that this bill, alongside the main Planning (Wales) Bill, will eventually lead to changes in planning law and procedure. The final passage and Royal Assent will signify the enactment of these changes, necessitating a review of internal processes and documentation related to planning applications and development in Wales.
What to do next
- Monitor for Royal Assent of the Planning (Consequential Provisions) (Wales) Bill.
- Review the enacted legislation and accompanying Explanatory Memorandum to understand amendments to planning enactments.
- Update internal policies and procedures related to planning and development in Wales once the bill becomes law.
