NYSERDA Annual Reporting Obligations Bill Amends Public Authorities Law
Summary
New York State Senate Bill S8019 amends Public Authorities Law §1867 to expand NYSERDA's annual reporting obligations. The bill also requires the report to include a brief summary of all proceeds collected pursuant to public service commission orders, including assessments, fees, taxes, transfers, corporate income, or surcharges on energy consumers or power generators. The bill passed the Senate on April 15, 2025.
What changed
Bill S8019 amends Section 1867 of the Public Authorities Law to expand NYSERDA's reporting distribution list and content requirements. The bill adds the chairs of the Senate Energy and Telecommunications Committee and the Assembly Energy Committee as required recipients of NYSERDA's semi-annual reports. Additionally, the bill adds subparagraph seven requiring NYSERDA to prepare a brief summary of all proceeds collected and administered pursuant to public service commission orders, including assessments, fees, taxes, transfers, corporate income, or surcharges imposed on energy consumers or power generators.
Affected parties include NYSERDA as the primary reporting entity, energy companies subject to assessments and surcharges, and legislative oversight committees. The bill aims to increase transparency and accessibility of information related to NYSERDA's funding by ensuring Energy Committee chairs receive direct oversight of the authority's financial activities.
