Summary

The Federal Communications Commission (FCC) has issued a notice requesting comments on an existing information collection activity related to Section 90.175(g)(2) of its rules. This notice is part of the FCC's ongoing effort to reduce paperwork burdens under the Paperwork Reduction Act (PRA). The comment period closes on May 26, 2026.

What changed

The Federal Communications Commission (FCC) has published a notice requesting public comments on an existing information collection activity, identified by OMB Control Number 3060-1313, concerning Section 90.175(g)(2) of its rules. This collection, titled "Amendment of Part 90 of the Commission's Rules," is an extension of a currently approved collection and applies to State, Local, or Tribal Governments. The FCC is seeking input on the necessity, utility, accuracy of burden estimates, and potential improvements to minimize the burden of this collection, which requires approximately 1 hour per response and is expected to total 190 hours annually.

Regulated entities, particularly State, Local, or Tribal Governments, should review the details of this information collection and consider submitting comments by the deadline of May 26, 2026. The purpose of this collection is to ensure public safety applicants seeking to license or modify facilities in the 4.9 GHz band do not interfere with incumbent licensees. While this is a notice for comment on an extension, entities should be aware of the PRA requirements, including the need for a valid OMB control number to avoid penalties for non-compliance.

What to do next

  1. Submit comments on the information collection by May 26, 2026.
  2. Review the details of OMB Control Number 3060-1313 and its impact on state, local, or tribal government respondents.

Penalties

No person shall be subject to any penalty for failing to comply with a collection of information subject to the PRA that does not display a valid Office of Management and Budget (OMB) control number.

collection of information is necessary for the proper performance of the functions of the Commission, including whether the
information shall have practical utility; the accuracy of the Commission's burden estimate; ways to enhance the quality, utility,
and clarity of the information collected; ways to minimize the burden of the collection of information on the respondents,
including the use of automated collection techniques or other forms of information technology; and ways to further reduce
the information collection burden on small business concerns with fewer than 25 employees.
