EFTA Surveillance Authority v Iceland - Explosives Precursors
Summary
The Court of Justice of the European Free Trade Association (EFTA) issued a judgment against Iceland in Case E-16/25 concerning the failure to implement Regulation (EU) 2019/1148 on the marketing and use of explosives precursors. This judgment confirms Iceland's obligation to comply with the EU regulation.
What changed
The EFTA Court has ruled against Iceland in Case E-16/25, finding that Iceland failed to fulfill its obligations by not properly implementing Regulation (EU) 2019/1148 concerning the marketing and use of explosives precursors. This judgment signifies a binding legal determination that Iceland has not met its commitments under the EEA Agreement regarding this specific regulation.
This ruling has direct implications for entities operating in Iceland that deal with explosives precursors. They must ensure full compliance with Regulation (EU) 2019/1148, which governs the sale, possession, and use of certain chemicals that can be misused to create explosives. Failure to comply could lead to enforcement actions by the EFTA Surveillance Authority or national authorities.
What to do next
- Review Iceland's implementation of Regulation (EU) 2019/1148
- Ensure compliance with marketing and use restrictions for explosives precursors in Iceland
