EFTA Authority v Liechtenstein - Failure to Implement Sale of Goods Directive
Summary
The EFTA Court has issued a judgment against Liechtenstein for failing to implement Directive (EU) 2019/771 concerning contracts for the sale of goods. This ruling signifies a binding decision on Liechtenstein's compliance with EU consumer protection law.
What changed
The EFTA Court has ruled in Case E-15/25, finding Liechtenstein in violation of its obligations by failing to implement Directive (EU) 2019/771, which governs contracts for the sale of goods. This judgment, dated December 10, 2025, establishes that Liechtenstein has not adequately transposed the provisions of this directive into its national law, impacting consumer rights related to goods purchased within the EFTA region.
This ruling has direct implications for Liechtenstein's legal framework concerning consumer sales. Regulated entities and legal professionals within Liechtenstein must ensure that national legislation is brought into full compliance with Directive (EU) 2019/771. Failure to do so could lead to further enforcement actions by the EFTA Surveillance Authority. While no specific compliance deadline is mentioned in this excerpt, Liechtenstein is expected to rectify the identified deficiencies promptly.
What to do next
- Review Liechtenstein's national laws for compliance with Directive (EU) 2019/771
- Ensure timely implementation of the directive's provisions into national legislation
