Strengthens Utility Storm Response Requirements
Summary
The New York State Senate has passed Bill S1701, which would amend the Public Service Law to strengthen utility storm response and compliance requirements. The bill would require review of mitigating factors in utility compliance assessments. The legislation has moved to the Assembly for consideration after passing the Senate with multiple co-sponsors.
What changed
The bill would amend multiple sections of the Public Service Law (§§25, 66, 94, 216, and 25-a) and add a new §25-b to strengthen utility storm response requirements. The legislation introduces review of mitigating factors in compliance assessments, potentially creating new standards for how utilities prepare for and respond to storm events.
Electric utilities operating in New York should monitor this legislation as it proceeds through the Assembly. If enacted, the bill could establish enhanced compliance obligations related to storm preparation, response times, and regulatory reporting. Companies may need to update emergency response plans and assess current infrastructure resilience measures.
What to do next
- Monitor the Assembly version (A2614) for movement through the legislative process
- Review current storm response and compliance protocols for alignment with proposed requirements
- Engage with industry associations or counsel regarding potential operational impacts
