Between De ce mbe r 15, 2 02 5, a nd F ebr uar y 12, 2 026, all Regulated Ent ities t ransacting any property and automob ile i nsurance bu siness shall prov ide grace pe riods of no les s than forty-five (45) d ays for non payment of pre mium and shall waiv e otherwise applicable charges and fees associated with nonpaymen t of premi um, such as late fe es and reinstatement fees. B. Between De ce mbe r 15, 2 02 5, a nd F ebr uar y 12, 2 026, no prop erty and automobi le insurer shall cancel a pol icy issued for nonpayment of premium, u nless spec ifically direct ed to do so by the insured. C. Between De ce mbe r 15, 2 02 5, a nd F ebr uar y 12, 2 026, the 45-day no tice period for nonrenewal notice s in RCW 48.18.2901(1)(a)(i) is su spended during the state of emergency. No p roperty and auto mobile insurer shall issue a not ice of nonrenew al less than 120 days befor e the expirat ion date of the pol icy.

On De cem be r 1 0, 2 025, t he Governor is sued Proc lamation 25-07 declaring an emergency related to the D ecember Atmosp heric River and Winter Weather Ev ent. The p roclamation provides in per tinent part as follows (empha sis adde d): I, Bob Ferguson, Gove rnor of the state of Wa shington, as a result of the above -not ed situation and under Ch apters 38.52 and 43.06 RCW, do hereby proclai m that a State of Emergency exis ts throughout th e entire state of Washington, and direct tha t the plans and procedures in the W ashington State Co mprehensiv e Emergency Ma nagement P lan be implemented. Sta te agencies and d epartments are directed to u tilize state resou rces in accordance with the Washi ngton State Compr ehensive Emergency Manage ment Plan and to do everything reasonably poss ible to assist a ffected politica l subdivisions in an effort to respond to and rec over from th is extreme we ather event. 2. The geographical extent of thi s emergency ord er is all area s of the state af fected b y flooding, lands lides, mudslides, ba nk erosion, or w ind damage a s a result of the Atmospheric Rive r and Wi nter Weather Event of Decembe r 2025 includ ing, but not limited to, Whatco m County, Skag it County, Sn ohomish County, K ing County, a nd Lewis County. 3. The De cemb er 20 25 A tmo sph eric R iver an d Wi nter Wea the r Ev ent has harmed or threatened to harm the property, safety and we lfare of Washington cit izens who h ave lost homes and other p roperty or w hose lives or e mployment hav e been otherwise disrupted by the December 202 5 Atm ospheric River and W inter Weathe r Event in the state of Washington. 4. RCW 48.02.060(4)(b) & (c) provides in pertinent part t hat, when the Governor procla ims a state of emergen cy under RC W 43.06.010(12), the Insurance Co mmissioner may issue an order that address es any o r all of the fo llowing matters rel ated to insurance p olicies issued in this state: (b) grace perio ds for payment o f insurance premiums and p erformanc e of other duties by insureds; and (c) tempo rary postpone ment of cancellat ions or nonrenew als. 5. RCW 48.02.060(5) provides tha t an order by the Insu rance Co mmissioner under su bsection (4) of this sect ion may rem ain effective fo r not more t han sixty (60) day s unless the Insurance Comm issioner ex tends the termin ation date f or the order for an additional pe riod of not more than th irty (30) days. The I nsurance Commi ssioner may extend the order i f, in the Insurance Co mmissione r’s judgment, the circumsta nces warrant an ex tension. An order of the Insurance C ommissioner u nder subsectio n (4) of this section is not effective af ter the related state of e mergency is termina ted by proc lamation of the Gov ernor under R CW 43.06.210. The orde r must specify, by l ine of insuran ce: (a) the geographic are as in which the order applies, wh ich must be w ithin but may be less exte nsive than the g eographic area specified in the Gove rnor’s proclamation of a state of emergency and must be s pecific according to an appropriate means of delineation, such as the United S tates pos tal service zip codes or othe r appropriate me ans; and (b) the date on which t he o rder b ecomes effective and t he date on w hich the o rder t ermina tes. 6. Emergency action by the Insurance Commission er is necessar y to p rotect th e property, safety, and welfare o f Washing ton citizens affect ed by the Dece mber 2025 Atmos pheric River and Winte r Weather Event in the state of Wa shin gto n.
