What changed

NDWEE is proposing to issue an air construction permit to POET Biorefining – Fairmont, LLC authorizing routing of fermentation emissions to Tallgrass High Plains Carbon Storage, LLC. The permit establishes specific conditions based on Title 129 Nebraska Air Quality Regulations, including revised acetaldehyde limits and requirements for Continuous Emission Monitoring Systems (CEMS). Affected parties including local residents, environmental groups, and the applicant may submit comments on new or significantly revised permit conditions through May 18, 2026, or petition the Director in writing for a public hearing on the proposal.

Ethanol manufacturing facilities and energy companies should monitor this permitting action as it establishes a precedent for routing fermentation emissions to carbon storage under Nebraska's air quality program. Interested parties have the opportunity to submit written comments addressing the proposed acetaldehyde limits, HAP emissions controls, and CEMS requirements before the permit becomes final.
