Summary

The UAE Ministry of Finance issued Ministerial Decision 336 of 2025 designating the Dubai Virtual Assets Regulatory Authority (VARA) as the Competent Authority for corporate tax purposes related to qualifying activities of Wealth and Investment Management Services and Fund Management Services. This designation applies to entities operating under Dubai Law No. 4 of 2022 regulating virtual assets.

What changed

Ministerial Decision 336 of 2025 formally designates the Dubai Virtual Assets Regulatory Authority (VARA) as the Competent Authority for administering corporate tax provisions related to specific qualifying activities in the virtual assets sector. Under Federal Decree-Law No. 47 of 2022 on Taxation of Corporations and Businesses, VARA will oversee entities providing Wealth and Investment Management Services and Fund Management Services involving virtual assets.

Virtual asset service providers, fund managers, and investment entities operating in Dubai must now interact with VARA for corporate tax compliance matters involving qualifying activity determinations. Entities claiming exemptions or benefits under the qualifying activities framework should ensure their operations align with VARA's regulatory definitions and maintain appropriate documentation for tax purposes.

What to do next

  1. Identify whether your virtual asset activities constitute qualifying Wealth Management, Investment Management, or Fund Management Services under Ministerial Decision 229 of 2025
  2. Register and comply with VARA requirements for corporate tax purposes if providing qualifying virtual asset services
  3. Maintain documentation demonstrating alignment with qualifying activity definitions for corporate tax exemptions
