What changed

The National Green Tribunal (NGT) heard Original Application No. 102/2022 (WZ) concerning environmental compensation. Counsel for the Maharashtra Pollution Control Board (MPCB) and other respondents informed the tribunal via email dated March 13, 2026, that they require an additional six weeks to devise and apply a formula for calculating Environmental Damage Compensation (EDC). This exercise has not yet been completed. Additionally, the tribunal directed counsel for respondents 6-12 and 14 to formally submit the judgments they have relied upon, with pagination, for the tribunal's review.

This hearing indicates that the calculation and imposition of environmental compensation are still under development for this case. Regulated entities involved, particularly those represented by the MPCB and other respondents, should anticipate a formal determination of EDC amounts following the next hearing. The need for additional time suggests complexity in the calculation methodology. Compliance officers should monitor the outcome of the next hearing on June 24, 2026, to understand the finalized EDC formula and any associated payment obligations.

What to do next

  1. Monitor next hearing on June 24, 2026, for finalized EDC calculation formula.
  2. Ensure relevant judgments are submitted to the NGT by the concerned respondents.
