Missouri Rule 10 CSR 10-5.570, Sulfur Emissions from Stationary Boilers

Email

Summary

The EPA Region 7 is proposing to approve Missouri State Implementation Plan (SIP) revisions submitted on November 10, 2020, by the Missouri Department of Natural Resources. The revisions amend Missouri Rule 10 CSR 10-5.570 to remove references to a revoked state regulation and make other minor administrative changes. The EPA views this as a non-controversial administrative action consistent with the Clean Air Act.

What changed

The EPA is proposing to approve Missouri's State Implementation Plan revisions to Rule 10 CSR 10-5.570, which controls sulfur emissions from stationary boilers. The revisions remove references to a revoked state regulation and make other minor administrative changes to align the SIP with current Missouri regulations. The EPA has simultaneously published a direct final rule approving these changes in the "Rules and Regulations" section of the Federal Register.

Affected parties should review these proposed changes to confirm they are accurate and do not inadvertently alter substantive emission requirements or compliance obligations. As this is a routine administrative alignment, it should not impose new compliance burdens on regulated entities. Facilities subject to sulfur emission controls under Missouri's rules should continue to comply with existing requirements while monitoring for the final rule publication.

What to do next

  1. Review the proposed SIP approval for Missouri Rule 10 CSR 10-5.570
  2. Submit comments by May 11, 2026 if adverse impacts are identified
  3. Monitor for subsequent final rule if no adverse comments are received

ACTION:

Proposed rule.

SUMMARY:

The Environmental Protection Agency (EPA) is proposing to approve Missouri State Implementation Plan (SIP) revisions submitted
on November 10, 2020, by the Missouri Department of Natural Resources (MoDNR). This proposed action will amend the SIP to
address administrative changes to the State rule in the Missouri Code of State Regulations (CSR). Revisions include removal
of references to a revoked state regulation and other minor administrative changes. The EPA is proposing to approve these
changes because they are consistent with the Clean Air Act (CAA) and applicable EPA regulations. In the “Rules and Regulations”
section of this
Federal Register
, we are approving the State's SIP revisions as a direct final rule without a prior proposed rule. If we receive no adverse
comment, we will not take further action on this proposed rule.

DATES:

Comments must be received by May 11, 2026.

on this proposed rule. If we receive adverse comment, we will withdraw the direct final rule and it will not take effect.
