What changed

The Delaware NPDES Construction General Permit has been reauthorized, replacing the prior version with an effective date of March 11, 2026. Permittees and co-permittees currently operating under an approved Notice of Intent must submit their reauthorization by June 15, 2026 to maintain continuous permit coverage for land-disturbing activities.

Affected construction site operators and developers in Delaware should verify their contact information is current with the Sediment and Stormwater Program, as reauthorization instructions were distributed via mail and email. Sites that fail to reauthorize by the deadline risk losing permit coverage, which could halt ongoing construction operations.

What to do next

  4. Delaware Construction General Permit Reauthorization
The Delaware NPDES Construction General Permit has been reauthorized and became effective on March 11, 2026. To maintain permit coverage for ongoing land-disturbing activities, each previously approved Notice of Intent must be reauthorized under the 2026 CGP by June 15, 2026. Instructions for this process have been shared via mail and email to all permittees and co- permittees. Instructions for completing the reauthorization process are available on the Sediment and Stormwater Program website. Questions should be directed to Joy Graves at 302-608-5463 or DNREC_enoiadmin@delaware.gov.

  5. Contact Information Reminder
The Sediment and Stormwater Program requests that Responsible Persons (Contractor Training Program certified) and CCRs keep their contact information up to date. This is important for recertification notifications and announcements sent via email. If you switch companies and have a new email address, it is your responsibility to contact the Program. Please email DNREC.Stormwater@delaware.gov when your information changes.

  6. Spring Growing Season - Don't hesitate to vegetate!
Take advantage of the season to establish a healthy cover of vegetation. Now is the time to establish permanent vegetative stabilization on sites that have been brought to final grade or temporary stabilization to other portions of the site. Don't forget the soil test! A soil test can save money and time. Knowing actual site conditions and needs will help avoid costly over-application or ineffective under-application of soil amendments and set the stage for successful seed germination. Follow the vegetative stabilization recommendations provided on the site's approved Sediment and Stormwater Management Plan with respect to the site and seedbed preparation, and application of soil amendments, seed, mulch, and mulch anchoring.
