Summary

The Council on Environmental Quality (CEQ) has issued a correction to its interim final rule implementing the National Environmental Policy Act (NEPA). This correction clarifies the words of issuance for the rule that removed CEQ's NEPA regulations from the Code of Federal Regulations.

What changed

The Council on Environmental Quality (CEQ) has published a correction to its interim final rule concerning the removal of its National Environmental Policy Act (NEPA) implementing regulations. The correction specifically amends the 'words of issuance' section to accurately reflect the authority under which the CEQ is acting, including referencing Executive Order 14154 and relevant statutes. This action does not alter the substance of the rule itself, which pertains to the removal and reservation of parts 1500-1508 of title 40 of the Code of Federal Regulations.

This correction is primarily technical and aims to ensure the legal accuracy of the original rule's issuance. Regulated entities, particularly government agencies involved in environmental reviews, should note this correction for their records. The effective date of the original rule and this correction remains April 11, 2025. No new compliance actions are required as a direct result of this correction; the focus remains on understanding the implications of the underlying NEPA regulations being removed from the Code of Federal Regulations.

What to do next

  1. Review the corrected language in the Federal Register notice for accuracy regarding CEQ's NEPA regulations.
  2. Ensure internal documentation reflects the corrected issuance language if referencing the rule.
