Exempt Wholesale Generator and Foreign Utility Company Status Approvals

FERC issued a notice confirming that Exempt Wholesale Generator and Foreign Utility Company status for 37 energy companies became effective by operation of the Commission's regulations during March 2026. Domestic approvals include solar projects (MEP Edinburg BESS LLC, Newton Solar BESS LLC, Steel River Solar I-III LLC, and others) and battery storage facilities (Mammoth Plains Energy Storage LLC, Atlas BESS IV LLC, Elawan Neutron Storage LLC). Foreign utility company approvals include Hexa India Companies, Hexa Japan Companies, Hexa Korea Companies, Hexa Philippines Companies, Hexa Taiwan Companies, Civitella Energy S.r.l, and others.

Affected parties should note the effective date of their status and ensure ongoing compliance with EWG requirements under 18 CFR 366.7(a). This is a routine administrative determination with no new compliance obligations imposed beyond existing regulatory requirements.
