Swinger, Commissioner Steve Henke, Administrative Law Judge On December 30, 2025, Duke Energy Indiana, LLC (“Duke Energy Indiana”) and Utilities District of Western Indiana Rural Electric Membership Corporation (“UDWI REMC”) (together, “Joint Petitioners”) filed their Verified Joint Petition to Modify Service Area Boundaries (“Joint Petition”) with the Indiana Utility Regulatory Commission (“Commission”). The Joint Petition seeks Commission approval for electric service area boundary changes on the U.S. Geological Survey (“USGS”) Facet Map L-22-1 in Monroe County, Indiana. Drawings of the agreed-upon boundary changes were attached to the Joint Petition, notices were published in newspapers of general circulation, and no affected electricity customer requested a hearing. On January 23, 2026, the Indiana Office of Utility Consumer Counselor (“OUCC”) filed its Notice of Intent to Not File Testimony. The Commission, having considered the evidence and applicable law, now finds: 1. Commission Jurisdiction and Joint Petitioners’ Characteristics. The Joint Petition seeks to change the Joint Petitioners’ assigned service areas. Agreements reached between electricity suppliers for boundary changes require approval from the Commission under Ind. Code § 8-1-2.3-6(a)(2). Both Joint Petitioners meet the definition of “electricity supplier” under Ind. Code § 8-1- 2.3-2(b). Duke Energy Indiana is a corporation organized under Indiana law, with its principal office at 1000 East Main Street, Plainfield, Indiana. UDWI REMC is a Rural Electric Membership Corporation organized under Indiana law, with its principal office in Bloomfield, Indiana. Both Joint Petitioners furnish retail electric service to the public in Indiana including Monroe County. - Relief Sought. Ind. Code § 8-1-2.3-6(a)(2) governs the change to service areas by mutual agreement of electricity suppliers. Joint Petitioners assert that, since the initial approval of the service area boundaries in Cause No. 36299-S231(X), circumstances have changed to warrant modifications to the existing boundaries. Specifically, property located at 2450 S. Endwright Rd., Bloomington, Indiana 47403 is within UDWI REMC’s service territory, but UDWI REMC lacks facilities in the area and is separated from that property by residential access issues. Joint Petitioners request modification to more efficiently provide electric service for this customer. The second page of Attachment A identifies a red outlined area, currently within UDWI REMC’s certified electric service territory, to be assigned to Duke Energy Indiana. Joint Petitioners state that the proposed modifications will not cause duplication of facilities, waste materials or resources, or cause uneconomic, inefficient, or inadequate electric service to the public. No contrary evidence has been presented to the Commission in this proceeding. 3. Notice. Ind. Code § 8-1-2.3-6(a)(2) provides, in relevant part: If notice of a verified request for a change of boundary lines by mutual agreement under this subdivision is published in a newspaper of general circulation in every county in which the boundary lines are located and an affected electricity customer does not request a hearing within twenty (20) days of the last date of publication, the [C]ommission may approve the change without a hearing. The record shows that notice of the Joint Petition was published on January 21, 2026 in the Herald Times, a newspaper of general circulation in the affected Monroe County (“Notice”). Joint Petitioners further certify that, under 170 IAC 1-1.1-9, notice was posted to https://www.duke- energy.com/home/billing/rates on January 21, 2026, and to https://www.udwiremc.com/ on January 26, 2026. Joint Petitioners represent that the website notices will remain for at least thirty days following this Order. Over twenty days have passed since the last date of newspaper publication of the Notice in the local newspapers, and no affected electricity customer requested a hearing. Under Ind. Code § 8-1-2.3-6(a)(2), the Commission may approve the requested boundary line changes without a hearing. 4. Approval of Requested Relief. Based on the foregoing findings, the Commission concludes that the agreed changes to Joint Petitioners’ service area boundaries located on USGS Facet Map L-22-1 meet the statutory requirements and that no evidence suggests that the changes will cause facility duplication, resource waste, or uneconomic, inefficient, or inadequate electric service to the public. To confirm compliance with this Order and accuracy of changes to the service area boundaries, Joint Petitioners shall notify the Commission staff upon adjustment of the Electric Service Territories boundaries layer at iurcapp.in.gov. IT IS THEREFORE ORDERED BY THE INDIANA UTILITY REGULATORY COMMISSION that: 1. Joint Petitioners’ agreed-upon service area boundary line changes, as set forth above and in the Joint Petition’s Attachment A filed in this Cause on December 30, 2025, are approved. 2. Within thirty days of this Order, Joint Petitioners must collaborate, coordinate, and verify the update to the service territory mapping system to reflect the modified service area boundaries as approved by this Order. Additionally, the electricity providers shall notify the Commission’s Energy Division staff at serviceterritory@urc.in.gov after updating the service territory mapping system to reflect the modified service area boundaries approved by this Order. 3. This Order is effective on and after the date of its approval.
