Summary

The Kentucky State Board on Electric Generation and Transmission Siting has issued a Second Request for Information directing MYSO LLC to respond to 19 interrogatories by May 6, 2026. The requests cover construction noise, traffic management, vegetative screening, battery energy storage system (BESS) specifications, and decommissioning commitments for a proposed 200 MW merchant solar facility in Graves County.

“The information requested is due on May 6, 2026.”

Why this matters

Solar and BESS project developers preparing Kentucky siting applications should ensure their filings address each of the 19 interrogatory categories identified here, particularly the BESS replacement logistics, construction traffic splits by entrance and phase, and the decommissioning commitment language that must appear in landowner lease agreements. The May 6 deadline is a hard compliance date under the Siting Board's procedural rules.

What changed

The Siting Board has issued 19 targeted interrogatories to MYSO LLC spanning construction noise mitigation, traffic distribution across site entrances, battery storage system specifications (including BESS unit count and 15–20 year replacement logistics), vegetative screening plans, and decommissioning commitments. MYSO must provide responses in searchable, bookmarked PDF format, identified by question number and responsible witness, under oath or certified by an authorized representative.\n\nDevelopers of comparable solar and storage projects in Kentucky should treat these interrogatories as a de facto checklist for Siting Board completeness expectations. Items such as color-coded participating/non-participating landowner identification, construction-phase traffic splits, and BESS end-of-life replacement planning represent specific documentation standards the Board is actively enforcing in current dockets.

What to do next

  1. MYSO LLC shall file an electronic version of the requested information with the Commission by May 6, 2026
  2. MYSO LLC shall answer each interrogatory under oath or accompanied by a signed certification of the preparer
  3. MYSO LLC shall make timely amendment to any prior response if it obtains information indicating a response was incorrect or incomplete
