Summary

The Hawaii Intermediate Court of Appeals granted a motion to dismiss an appeal filed by Agrifina Quiane against West Physicians Associates, LLC. The court found that the appealed order was not an appealable collateral order and lacked jurisdiction for an interlocutory appeal.

What changed

The Hawaii Intermediate Court of Appeals has issued an order granting the motion to dismiss an appeal filed by Agrifina Quiane. The appeal was against an order from the District Court of the First Circuit concerning contempt sanctions. The appellate court determined that the district court's order was not an appealable collateral order as it did not require Quiane to pay a specific amount by a specific date, nor did it meet the criteria for an interlocutory appeal under established legal doctrines or statutes.

This ruling means the appeal is dismissed, and all related pending motions are also dismissed. This action effectively upholds the district court's decision by preventing further review at the appellate level due to a lack of jurisdiction. Regulated entities facing similar procedural issues should ensure that any orders they seek to appeal meet the strict criteria for appealability, particularly regarding finality and the nature of the order itself, to avoid dismissal.

What to do next

  1. Review internal procedures for appealability of court orders.
  2. Consult with legal counsel regarding the requirements for interlocutory appeals.
