What changed

The IOPC concluded its independent investigation into the fatal collision and referred evidence files to the Crown Prosecution Service, which authorized criminal charges against both officers. PC Chris Johnson, the driver of the police vehicle directly involved in the collision, faces the more serious charge of causing death by dangerous driving. Former PC Danny Tomkins faces dangerous driving charges relating to his alleged manner of driving at the time.

For law enforcement agencies and police conduct oversight bodies, this case highlights continued scrutiny of police road traffic practices and the standards applied to officers operating police vehicles. The charges underscore that police officers can face criminal liability for dangerous driving regardless of whether they were responding to incidents. The scheduled court date of 28 May 2026 will determine the outcome of these charges.

What to do next

  1. Law enforcement agencies should review policies on unmarked vehicle pursuits
  2. Legal professionals should monitor the Westminster Magistrates' Court proceedings on 28 May 2026

Two Met officers charged following investigation into fatal road collision

| Two Met officers – one of whom is no longer serving - have been charged in connection with a fatal road collision in south-east London in 2024.

It follows an Independent Office for Police Conduct investigation into the incident, where a 38-year-old woman* and her unborn child died after her vehicle was involved in a collision with a police vehicle on the A20 in Eltham on 17 October, 2024.

The officers were driving in two unmarked police cars in response to an unrelated incident, when one of the vehicles was involved in the fatal collision.

PC Chris Johnson, the driver of the police vehicle involved in the collision, has been charged with causing death by dangerous driving.

Former PC Danny Tomkins, the driver of the second police vehicle, has been charged with dangerous driving, which relates to his alleged manner of driving.

They are both due to appear at the Westminster Magistrates’ Court on 28 May, 2026.

We began an independent investigation following a mandatory referral from the Met. At the conclusion of our investigation in October 2025, we decided to refer files of evidence to the Crown Prosecution Service, which authorised the charges.
