What changed

The Fourth District Court of Appeal reversed the Palm Beach County Court's order denying the appellant's motion to transfer venue, accepting the appellee's confession of error as sufficient grounds for reversal. The appellate court ordered the case transferred to Orange County, Florida, and instructed that the mandate shall issue immediately with no rehearing motions accepted.

For parties involved in Florida civil litigation, this ruling underscores the importance of proper venue selection and the procedural implications of venue transfer motions. Litigation counsel should ensure venue requirements are met when filing cases and when challenging venue in county court proceedings. The appellee's confession of error provides a streamlined path for reversal but does not prevent the appellant from seeking costs or other relief associated with the venue dispute.

What to do next

  1. Monitor for venue transfer compliance in the lower court proceedings
  2. Ensure all future filings are directed to the appropriate venue (Orange County)
