Summary

The Louisiana Court of Appeal, First Circuit denied defendant Darryl Sartain's supervisory writ application because it lacked required documents including the district court ruling, court minutes, Boykin transcript, and sentencing transcript. The court stated it will not consider supplementation of this application or a rehearing. The defendant may file a new application without obtaining a return date, provided it includes all required documentation.

What changed

The Louisiana Court of Appeal, First Circuit denied a supervisory writ application filed by criminal defendant Darryl Sartain (Docket No. 2026 KW 0063) on procedural grounds. The court found the application deficient because the relator failed to include essential documents from the district court record necessary for appellate review. The court invoked Uniform Rules of Louisiana Courts of Appeal, Rules 2-18.7 and 4-9 as the basis for its ruling.

The practical implication is that incomplete writ applications will be summarily denied without opportunity for supplementation. Defendants seeking supervisory review must compile a complete record including the district court ruling, court minutes, Boykin transcript, and sentencing transcript before filing. While the defendant retains the right to file a new application without a return date, any future filing must include the entire application and all missing documents.

What to do next

  1. Legal professionals: Include all required court documents when filing supervisory writs in Louisiana
  2. Criminal defendants: Ensure complete district court record before seeking appellate review
  3. Court clerks: Verify document completeness before accepting writ applications
