Louisiana Court of Appeal: Succession of Van Royal Small Sr.
Summary
The Louisiana Court of Appeal denied a writ application in the succession of Van Royal Small Sr. due to incomplete documentation, violating court rules. The court specified that supplementation or a new application must include all missing pleadings, transcripts, and evidence by April 20, 2026.
What changed
The Louisiana Court of Appeal, First Circuit, denied a writ application concerning the succession of Van Royal Small Sr. The denial was based on the applicant's failure to comply with Uniform Rules of Louisiana Courts of Appeal, specifically Rule 4-5(C)(8), by not including essential documents such as the memorandum in support of the motion to compel, attachments, the hearing transcript, and all introduced evidence.
Relators seeking to refile must ensure their application is complete with all required documentation, including the previously omitted items, and must adhere to Rule 2-12.2. Any new application must be filed by April 20, 2026, and must include a copy of this ruling. Failure to comply with these procedural requirements means the writ application will not be considered, and supplementation or rehearing will not be entertained.
What to do next
- Ensure any refiled writ application includes all required documentation as specified in the ruling.
- File any new application on or before April 20, 2026.
- Include a copy of this ruling with any new application.
