What changed

The court ordered immediate transfer of the habeas petition to the Southern District of Iowa, applying the general rule that habeas jurisdiction lies in the district of confinement. The petitioner sought release from ICE custody but was held at Polk County Jail in Iowa. This is a procedural venue determination with no substantive ruling on the merits.

Immigration detainees and their legal counsel filing habeas petitions should be aware that venue is proper in the district where the petitioner is confined, not necessarily where the petition is initially filed. This procedural transfer does not affect substantive rights but may impact litigation timing and strategy.
