Summary

BAILII deployed Anubis, a proof-of-work anti-bot system, to protect its servers against AI scraping. The system uses a Hashcash-style proof-of-work scheme to increase the cost of mass scraping while remaining negligible for individual users. Users with JavaScript-blocking plugins such as JShelter may experience access issues and are instructed to disable such extensions for the BAILII domain.

What changed

This is not a regulatory document but rather a bot verification landing page from BAILII that appears when automated systems attempt to access EU court case databases. The page describes the deployment of Anubis, a proof-of-work system designed to make mass scraping more resource-intensive. The system is presented as a temporary measure while more sophisticated fingerprinting of headless browsers is developed. There are no compliance obligations, enforcement actions, or regulatory requirements contained in this page.

For compliance professionals and legal researchers: this page indicates that automated bulk downloading of EU court decisions from BAILII is actively blocked. Researchers relying on automated data collection from BAILII should expect access restrictions and may need to adjust their data acquisition methods or seek alternative sources for EU case law.

You are seeing this because the administrator of this website has set up Anubis to protect the server against the scourge of AI companies aggressively scraping websites. This can and does cause downtime for the websites, which makes their resources inaccessible for everyone.

Anubis is a compromise. Anubis uses a Proof-of-Work scheme in the vein of Hashcash, a proposed proof-of-work scheme for reducing email spam. The idea is that at individual scales the additional load is ignorable, but at mass scraper levels it adds up and makes scraping much more expensive.

Ultimately, this is a placeholder solution so that more time can be spent on fingerprinting and identifying headless browsers (EG: via how they do font rendering) so that the challenge proof of work page doesn't need to be presented to users that are much more likely to be legitimate.

Please note that Anubis requires the use of modern JavaScript features that plugins like JShelter will disable. Please disable JShelter or other such plugins for this domain.
