Liberty Global / Telefonica / Infravia Merger - EU Non-Opposition
Summary
The European Commission issued a non-opposition decision (Case M.12367) clearing the notified concentration involving Liberty Global, Telefonica, Infravia, Netomnia, and BRSK Assets. The merger has been approved without conditions, allowing the transaction to proceed in the European Union market.
What changed
The European Commission determined that the notified concentration involving Liberty Global, Telefonica, Infravia, Netomnia, and BRSK Assets does not raise competition concerns under EU merger regulations. The Commission issued a formal non-opposition decision, clearing the way for the transaction to proceed.
For the parties involved, this EC clearance represents the primary regulatory hurdle for EU operations being resolved favorably. The merger may still require approvals in other jurisdictions where the parties operate. Investors and stakeholders in Liberty Global and Telefonica can anticipate the transaction progressing toward closing, subject to remaining regulatory conditions in other markets.
What to do next
- Monitor for any follow-up EC requests or remedies
- Proceed with transaction closing subject to other jurisdictional approvals
