Meet the Experts Behind the new Settlement Agreement Policy and the Publication of the Enforcement Guide

Last week, the FIAU announced a dedicated training session on its new Settlement Agreement Policy and Enforcement Guide, and their application within the enforcement process. Today, we turn the spotlight to the speakers who will bring the policy to life and the practical questions they will be tackling.

Because understanding the policy is one thing. Knowing how it is applied in practice is another.

Setting the regulatory context

The session will open and close with senior regulatory leadership, anchoring the discussion in both policy intent and enforcement reality.

Mr Alfred Zammit, Director of the FIAU, and Mr Kenneth Farrugia, CEO of the MFSA and Chairman of the FIAU, will frame the discussion from a strategic and supervisory perspective. Drawing on extensive experience in AML/CFT supervision, enforcement and international engagement, they will set the tone for a session focused not just on rules but on outcomes.

Enforcement, discretion and remediation: what really matters

At the heart of the training is an expert panel of FIAU professionals directly involved in enforcement decision‑making, legal assessment and remediation oversight.

Ms Elena Tabone, Head of Enforcement, will discuss how settlement considerations arise in practice, explaining enforcement priorities, cooperation expectations and the role remediation plays when assessing outcomes.

From a legal perspective, Dr Jonathan Phyall, Head of Legal Affairs, will explain the foundations of settlement mechanisms, based on his experience in legislative drafting and participation in international AML/CFT fora. This session promises to clarify where discretion begins and where it ends.

From theory to reality: how cases unfold

The training will also draw on operational experiences and the introduction of settlements across the enforcement lifecycle.

Mr Ian Bugeja, Enforcement Manager and Lead for Corrective Actions, and Mr Jeremy Mercieca Abela, Enforcement Manager and Lead for Operational Cases, will share operational insights into administrative measures, corrective action expectations and how different circumstances can shape enforcement outcomes.

Adding to this, perspectives from Dr Jean Paul Cassar, Senior Manager, Dr Denise Frendo, Senior Court Litigation Associate, and Ms Martha Mallia Pawley and Ms Rosemarie Zammit will bring valuable insight into the settlement procedures introduced, and the role of settlement agreements and out-of-court settlement decisions within the enforcement stage.
