Summary

The FDIC invites public comment on the renewal of two existing information collections under the Paperwork Reduction Act: OMB Control No. 3064-0029 covering bank service company notifications (Form 6120/06, 313 annual burden hours) and OMB Control No. 3064-0177 covering securitization disclosure requirements for assets transferred in connection with securitizations or participations after September 30, 2010 (7,008 annual burden hours). Neither collection involves changes to substance or methodology. Comments are due June 22, 2026.

What changed

The FDIC is seeking public comment on the renewal of two existing information collections without substantive change. The first collection (OMB 3064-0029) requires insured state nonmember banks to notify the FDIC of relationships with bank service companies under the Bank Service Company Act. The second (OMB 3064-0177) implements 12 CFR 360.6 conditions for securitization transactions to receive special treatment when the FDIC is appointed as receiver or conservator.

Insured state nonmember banks and insured depository institutions that sponsor securitizations should review the burden estimates and consider whether the collections remain necessary. Banks with bank service company relationships that use Form 6120/06 may note the estimated annual burden decreased from 325 to 313 hours. Securitization sponsors should confirm their disclosure and recordkeeping practices align with 12 CFR 360.6 requirements. All comments become part of the public record.

| Note: The estimated annual IC time burden is the product, rounded to the nearest hour, of the estimated annual number of responses and the estimated time per response for a given IC. The estimated annual number of responses is the product, rounded to the nearest whole number, of the estimated annual number of respondents and the estimated annual number of responses per respondent. This methodology ensures the estimated annual burdens in the table are consistent with the values recorded in OMB's consolidated information system. |
( printed page 21291) General Description of Collection: Insured state nonmember banks are required to notify the FDIC, under section 7 of the Bank Service Company Act (12 U.S.C. 1867), of the relationship with a bank service company. The Form FDIC 6120/06, Notification of Performance of Bank Services, may be used by banks to satisfy the notification requirement. There is no change in the method or substance of the collection. The estimated annual burden has decreased by 12 hours, from 325 hours in 2023 to 313 hours in this ICR. This decrease is attributable to a reduction in the estimated number of responses. The time and frequency of responses remain unchanged.

As part of these conditions, securitization documents must include certain disclosure and recordkeeping requirements. There is no change in the method or substance of the collection.
