Summary

The Consumer Financial Protection Bureau (CFPB) is requesting comments on the reinstatement of an information collection related to the Interstate Land Sales Full Disclosure Act (ILSA). This includes Regulations J, K, and L, which require land developers to register subdivisions and provide property reports to purchasers.

What changed

The Consumer Financial Protection Bureau (CFPB) has issued a notice and request for comment regarding the reinstatement of an information collection titled "Interstate Land Sales Full Disclosure Act (Regulations J, K, and L)" under OMB Control Number 3170-0012. This action pertains to the information collection requirements mandated by the ILSA, which requires land developers to register subdivisions of 100 or more non-exempt lots and provide purchasers with a property report. The CFPB is seeking public input on the necessity, accuracy, utility, and clarity of this information collection, as well as methods to minimize the burden on respondents.

Regulated entities, specifically businesses or other for-profits involved in land development, should review the information collection and submit written comments by April 20, 2026, to ensure their feedback is considered. The CFPB is particularly interested in comments addressing the practical utility of the information, the accuracy of the estimated burden hours (currently 3,412 hours for 197 respondents), and potential improvements through technology. Comments will be reviewed by the Office of Management and Budget (OMB) as part of its review process and will become public record.

What to do next

  1. Submit written comments on the information collection by April 20, 2026.

OMB Control Number: 3170-0012.

Abstract: The Interstate Land Sales Full Disclosure Act (ILSA) requires land developers to register subdivisions of 100 or more non-exempt
lots with the Bureau before selling or leasing the lots, and to provide each lot purchaser with a disclosure document designated
as a property report, 15 U.S.C. 1703-1704. ILSA was enacted in response to a nationwide proliferation of developers of unimproved

who are not in compliance with the regulations.

comments on: (a) Whether the collection of information is necessary for the proper performance of the functions of the CFPB,
including whether the information will have practical utility; (b) The accuracy of the CFPB's estimate of the burden of the
collection of information, including the validity of the methods and the assumptions used; (c) Ways to enhance the quality,
utility, and clarity of the information to be collected; and (d) Ways to minimize the burden of the collection of information
on respondents, including through the use of automated collection techniques or other forms of information technology. Comments
submitted in response to this notice will be reviewed by OMB as part of its review of this request. All comments will become
a matter of public record.
