Email

Summary

The Federal Railroad Administration (FRA) has issued a notice regarding a petition for waiver filed by Reading Blue Mountain and Northern Railroad (RBMN). RBMN seeks relief from certain regulations concerning the stenciling and reflectorization of rail cars, specifically for caboose RBMN 478044. The public comment period for this petition closes on April 6, 2026.

What changed

The Federal Railroad Administration (FRA) has published a notice concerning a petition for waiver filed by Reading Blue Mountain and Northern Railroad (RBMN). RBMN is requesting a special approval and waiver of compliance from specific Federal railroad safety regulations, namely 49 CFR part 215, Subpart D (Stenciling) and part 224 (Reflectorization of Rail Freight Rolling Stock). The petition specifically pertains to caboose RBMN 478044, which is over 50 years old, and RBMN asserts it will not be interchanged with other railroads and has a sound body.

Interested parties, including compliance officers in the rail industry, are invited to submit written comments, data, or views to the FRA by April 6, 2026. These comments will be considered before the FRA makes a final decision on RBMN's petition. While the notice does not specify penalties for non-compliance with the existing regulations, failure to adhere to the final decision on the waiver could result in enforcement actions. Regulated entities should review the petition details and consider submitting comments if they have relevant input or concerns regarding the potential precedent set by granting this waiver.

What to do next

  1. Review RBMN's petition for waiver regarding stenciling and reflectorization regulations.
  2. Submit comments or data to FRA by April 6, 2026, if relevant to the petition.
  3. Monitor FRA's final decision on the waiver request.
