Summary

The Federal Maritime Commission has issued an Order Directing Hapag-Lloyd AG to Show Cause in Docket No. CC-002. This investigation will determine if Hapag-Lloyd AG should be ordered to refund or waive charges for failing to comply with specific U.S. maritime regulations.

What changed

The Federal Maritime Commission (FMC) has initiated an investigation into Hapag-Lloyd AG's compliance with 46 U.S.C. 41104(a), specifically concerning charges assessed for failure to comply with subsections (a)(14) and (a)(15)(B). This action, formalized by an Order Directing Hapag-Lloyd AG to Show Cause issued on March 6, 2026, in Docket No. CC-002, seeks to determine if the company should be compelled to refund or waive these charges.

Regulated entities, particularly those in the maritime shipping industry, should be aware of this investigation as it sets a precedent for enforcement of compliance with specific statutory requirements. Hapag-Lloyd AG is required to respond to the order to show cause, and the outcome could lead to financial penalties in the form of refunds or waived charges. Compliance officers should review the cited statutes and regulations to ensure adherence and prepare for potential scrutiny.

What to do next

  1. Review the FMC Order Directing Hapag-Lloyd AG to Show Cause in Docket No. CC-002.
  2. Assess compliance with 46 U.S.C. 41104(a)(14) and 41104(a)(15)(B).
  3. Consult legal counsel regarding potential implications and response strategies.
