Summary

The U.S. International Trade Commission (USITC) has instituted a Section 337 investigation into certain Magnetoresistive Random Access Memory (MRAM) devices, products containing them, and components thereof. The investigation is based on a complaint alleging infringement of asserted patents.

What changed

The U.S. International Trade Commission (USITC) has initiated Section 337 investigation number 337-TA-1487 concerning certain Magnetoresistive Random Access Memory (MRAM) devices, products containing them, and components thereof. The investigation stems from a complaint filed by Avalanche Technology, Inc., alleging that imports and sales by respondent Everspin Technologies, Inc. infringe on certain patents. The complainant is seeking a limited exclusion order and a cease and desist order.

This institution of an investigation does not constitute a determination on the merits of the case. An Administrative Law Judge will preside over the proceedings, including an evidentiary hearing, and will issue an initial determination. The USITC will then make a final determination. While a target date for completion will be set within 45 days, the USITC's remedial orders are effective upon issuance and become final 60 days thereafter, unless disapproved by the U.S. Trade Representative. Companies involved in the import or sale of MRAM devices should monitor this investigation closely.

What to do next

  1. Monitor the progress of USITC investigation 337-TA-1487.
  2. Review patent infringement claims and import/sale activities related to MRAM devices.

Penalties

The complainant is requesting a limited exclusion order and a cease and desist order.

The U.S. International Trade Commission (Commission or USITC) voted to institute an investigation of certain magnetoresistive random access memory (MRAM) devices, products containing same and components thereof. The products at issue in the investigation are described in the Commission’s notice of investigation.

The investigation is based on a complaint filed on behalf of Avalanche Technology, Inc. of Fremont, California, on January 28, 2026. An amended complaint was filed on February 5, 2026.  The amended complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain magnetoresistive random access memory (MRAM) devices, products containing same and components thereof that infringe certain claims of the patents asserted by the complainant. The complainant requests that the USITC issue a limited exclusion order and a cease and desist order.

The USITC has identified the respondent in this investigation as Everspin Technologies, Inc. of Chandler, Arizona.

By instituting this investigation (337-TA-1487), the USITC has not yet made any decision on the merits of the case. The USITC’s Chief Administrative Law Judge will assign the case to one of the USITC’s administrative law judges (ALJ), who will schedule and hold an evidentiary hearing. The ALJ will make an initial determination as to whether there is a violation of section 337; that initial determination is subject to review by the Commission.

The USITC will make a final determination in the investigation at the earliest practicable time. Within 45 days after institution of the investigation, the USITC will set a target date for completing the investigation. USITC remedial orders in section 337 cases are effective when issued and become final 60 days after issuance unless disapproved for policy reasons by the U.S. Trade Representative within that 60-day period.
