What changed

The Florida District Court of Appeal has issued an opinion in the case of John McDonald v. Amanda McDonald, docket number 5D2026-0436. The court previously denied the petitioner's writ of prohibition and is now cautioning the pro se petitioner against further repetitive, frivolous, and abusive filings related to the underlying circuit court case. The court explicitly warned that future filings may lead to sanctions, including a potential prohibition against future pro se filings.

This action serves as a warning to pro se litigants and their legal counsel regarding the consequences of filing frivolous or abusive motions. Compliance officers should note that courts are increasingly willing to impose sanctions, including barring future appearances, for such conduct. While this specific case involves a pro se litigant, the underlying principle applies to all filings, and legal teams should ensure all submissions are well-founded and not repetitive or abusive to avoid potential sanctions.

What to do next

  1. Review court's warning regarding frivolous and abusive filings.
  2. Ensure all future filings in this matter are non-repetitive and non-frivolous.
  3. Consult internal legal counsel regarding potential sanctions for continued abusive pro se litigation.

Penalties

Sanctions may include prohibition against future pro se filings.

March 13, 2026

PER CURIAM.

This Court previously denied Petitioner’s petition for writ of
prohibition arising from Flagler County Circuit Court Case No.
2025-DR-000681. Because Petitioner’s filings in this Court related
to that case appear to be repetitive, frivolous, and abusive,
Petitioner is cautioned that any further frivolous or abusive pro se
filings in this Court arising from that circuit court case may result
in sanctions, including a prohibition against future pro se filings
in this Court. See State v. Spencer, 751 So. 2d 47 (Fla. 1999).
PETITIONER WARNED.

JAY, C.J., and EISNAUGLE and MACIVER, JJ., concur.
