Summary
The Texas Court of Appeals, 10th District (Waco) has dismissed the appeal in Cleve Wells v. Dustin Lee Chestnut, case number 10-25-00454-CV. The dismissal is for want of prosecution and failure to follow a directive of the Clerk of the Court.
What changed
The Texas Court of Appeals, 10th District (Waco) has issued a memorandum opinion dismissing the appeal in Cleve Wells v. Dustin Lee Chestnut (Docket Number: 10-25-00454-CV). The dismissal is due to the appellant's failure to file a brief by the court-ordered deadline of February 25, 2026, and for not responding to the Clerk's notification regarding the late filing. This action effectively ends the appellate proceedings for this landlord and tenant dispute.
This ruling signifies the final disposition of the appeal. For parties involved, this means the trial court's judgment stands, and no further action can be taken at the appellate level in this case. The dismissal is based on procedural grounds, specifically the failure to prosecute the appeal according to court rules and directives.

MEMORANDUM OPINION
Cleve Wells appealed a judgment signed by the trial court on November
17, 2025. The Appellant’s brief was initially due on January 14, 2026. By
letter from the Clerk dated February 4, 2026, Appellant was notified that his
brief was late and that “unless Appellant’s brief or a response showing grounds
for continuing this appeal is filed by appellant or any party desiring to continue
this appeal on or before Wednesday, February 25, 2026, the court may
dismiss the appeal for want of prosecution.” (emphasis in original.)
